Judge stops moving 3 transgender inmates to men’s prison


A federal judge in Washington, D.C. granted a temporary restraining order to block prison officials from transferring three transgender women to men’s facilities and ending their access to hormone therapy, as mandated by an executive order signed by President Trump. The judge ruled that Trump’s order discriminates against transgender individuals and violates their constitutional rights. These women were previously housed in women’s facilities before the order was signed. Another federal judge in Boston issued a similar restraining order for one transgender woman in a women’s prison in a separate case.

Trump’s order requires the Bureau of Prisons to ensure that males are not housed in women’s prisons and prohibits the use of federal funds to change an inmate’s appearance to match the opposite sex. The plaintiffs argue that moving them to men’s prisons would endanger their safety and mental well-being. Their access to hormone therapy for their gender dysphoria, a condition linked to depression and suicidal thoughts, would also be disrupted.

The judge acknowledged that the public interest in relocating the plaintiffs to male facilities was minimal and ruled in favor of the plaintiffs, represented by the National Center for Lesbian Rights and GLAD Law. The plaintiffs, who were segregated with other transgender women after being removed from general women’s prison populations in anticipation of transfers, fear violence and sexual assault in men’s facilities. The plaintiffs argue that Trump’s order violates their constitutional rights and are seeking to maintain their current placement in women’s facilities. The Bureau of Prisons has not yet decided on where to transfer the plaintiffs, and a Justice Department attorney stated that they have not been denied medical care since the executive order was signed.
