Mona’s Ladies Lounge successfully appeals to continue excluding men from entry

Tasmania’s Museum of Old and New Art (Mona) has successfully appealed in the state’s supreme court to continue barring men from entering the Ladies Lounge installation. The museum had closed the female-only space in April after a complaint from a man that it was discriminatory, but the court ruled that the Ladies Lounge qualifies for an exemption from the anti-discrimination act.

Justice Shane Marshall stated that the Ladies Lounge is an arrangement to promote equal opportunity by highlighting the lack of equal opportunity generally prevailing in society, giving women a rare glimpse of what it is like to be advantaged rather than disadvantaged. He found that the tribunal had made errors in its decision, including mischaracterizing the purpose of the Ladies Lounge.

The court’s decision has sent the case back to the tribunal to be reconsidered. Mona now has the green light to continue barring men from the Ladies Lounge, in a move that is seen as promoting equal opportunity and raising awareness about gender discrimination. The museum’s unique approach to addressing gender imbalance has been supported by the court, allowing Mona to maintain its exclusive female-only space within the museum.
