Home Depot Settles Suit Alleging Overcharging, Agrees to Pay Nearly $2 Million to Shoppers.


The Home Depot has agreed to a settlement of nearly $2 million in a case where it was accused of overcharging customers by charging more for items at checkout than the advertised price. Prosecutors in six California counties alleged that the “scanner violations” resulted in higher prices for customers. The settlement, approved by a judge, does not include an admission of wrongdoing from Home Depot. The settlement includes $1.7 million to be divided among the district attorneys’ offices of the six counties for consumer law enforcement, as well as funds for consumer regulators and agricultural consumer watchdog nonprofits. Home Depot is required to always use the lowest price posted, hire an internal price watchdog, assign price accuracy checks to a manager in each California store, and make records of price accuracy available to prosecutors.

Los Angeles County District Attorney George Gascón, representing his office as a lead plaintiff, stated that companies engaging in deceptive practices cheat consumers and gain an unfair advantage over ethical businesses. He emphasized the message that such behavior will not be tolerated, and the settlement highlights the commitment to safeguarding consumer rights. Home Depot, based in Atlanta, reported nearly $22 billion in operating profit for the 2023 fiscal year. This settlement serves as a clear message that deceptive practices will not be tolerated and underscores the importance of protecting consumer rights.
